Bobby J. Buchanans conviction of larceny was affirmed. State v. Buchanan, 76 N.M. 141, 412 P.2d 565. He thereafter filed a Rule 93 motion seeking vacation of the judgment and sentence upon the single allegation that the prosecuting attorney in argument to the jury stated that the defendant must have been guilty or he would have taken the stand to testify in his own behalf. Relief was denied by the trial court without a hearing; the order recited that the question could not properly be raised by a Rule 93 motion because it should have been raised in the direct appeal of the criminal case. Petitioner has appealed the order denying Rule 93 relief.
